You must only contact leaseholders and other users of this site with the sole intent of wanting to rent out the apartment that is being listed. Users should not be contacted for any other reason. Under no conditions, should you spam other users.

You may not post a listing unless you have the legal right to do so. This includes ownership, a lease that permits subletting, a valid lease assignment, a lawful lease break, or written authorization (such as a property management agreement) giving you the authority to advertise and rent the property. By posting a listing, you represent and warrant that you have sufficient rights in and to the accommodation to legally host or transfer occupancy, and that you are directly responsible — together with any property owner or fiduciary you represent — for the guest experience, including communication, accuracy of information, check-in, stay, and reasonable issue resolution.

You own or have permission to use all content including images and videos (“Your Content”) that you post on Leasebreak.com. As such, you hereby irrevocably grant us world-wide, non-exclusive, royalty-free, sublicensable, transferable rights to use Your Content for any purpose. This could include - but is not limited to - posting your apartment details on other websites, in our marketing materials, or on social media platforms.

You are solely responsible for any content that you post on our web site and you should use reasonable judgment in the content you choose to post. While under no obligation to do so, Leasebreak.com can remove the content you post, delete your apartment listing completely or delete your entire account at any time and with no stated reason. Note that if we are contacted by the owner, landlord, or someone representing the owner or landlord asking to remove a particular listing, we are inclined to remove the listing because we believe the landlord needs to be an integral part of the process, and an apartment should not be posted without their permission.

If you post on our website and you receive an inquiry, you should use your own judgement as to whether or not you want to show the listed apartment to this person. Leasebreak does not make any representation regarding the validity of the information provided by a registered user. Please proceed cautiously.

However, if you post on our website, you are expected and obligated to respond to all inquiries that appear to be valid inquiries. Also, we do not allow you to use auto-responders which direct people to other websites. Also, we do not allow a listing to be appear more than once at the same time on our website, whether or not the listing is posted by the same user or not. Your inventory with Leasebreak needs to be kept updated and accurate. Also, all agents who post on our website must "co-broke" and respond to inquiries from fellow agent colleagues as promptly as you would respond to non-agents.

By accessing or using our platform, you acknowledge that your use involves inherent risks, including but not limited to, data breaches, hacking, and other unauthorized access to sensitive information. We shall not be liable for any damages or losses arising from such incidents. It is your responsibility to exercise caution and discretion when sharing sensitive information on our platform.

Users acknowledge that they interact with rental listings and other third-party content at their own risk. Content Moderation Rights: While we do not create, verify, or control third-party content, we reserve the right to monitor, moderate, or remove content that violates our terms, applicable laws, or poses a risk to our community. This moderation is conducted at our discretion and does not alter our protections under Section 230.

PLATFORM INTEGRITY AND OFF-PLATFORM CONDUCT. Users who post listings on Leasebreak agree to conduct themselves in a professional, lawful, and commercially reasonable manner in all interactions arising from their use of the platform, including but not limited to communications, transactions, and dealings with prospective or former tenants. Leasebreak reserves the right to review and investigate complaints related to listings, including matters that occur outside of the platform, where such matters reasonably relate to a listing or a transaction initiated through Leasebreak. Users are required to comply with the Fair Housing Act and all other applicable federal, state, and local laws. Failure to comply may result in removal of listings, suspension, or termination of access to the platform. If we determine, in our sole discretion, that a user’s conduct may violate applicable laws, create risk for other users, or negatively impact the integrity of the marketplace, we may take action. Such actions may include, but are not limited to, removing listings, suspending or terminating accounts, or restricting access to services, regardless of whether Leasebreak is a party to the underlying transaction.

FEES. We charge fees for certain services on our website. We show you the fee before you have to pay. All fees are non-refundable, except as specifically stated in the “Refunds” section below. For most services (including three of the four PREMIUM plans), your card is charged one time per service. We may change the fees at any time.

NO REFUNDS FOR ACCOUNTS TERMINATED FOR TERMS OF SERVICE VIOLATIONS, INCLUDING IMPERSONATION, FRAUD, OR SECURITY ABUSE.

PREMIUM PLAN (Bi-Weekly Recurring). One PREMIUM option is a recurring plan billed at $20 every two weeks. By signing up, you authorize us to charge your card automatically every two weeks until you cancel. All payments are non-refundable once processed. You may cancel this recurring PREMIUM plan at any time in your account settings, but you must cancel before the next billing date to avoid additional charges.

MONTHLY PLANS. For certain services, we offer “Monthly Plans.” These are billed on a recurring monthly basis, as stated at signup. By signing up, you authorize us to charge your card automatically each month until you cancel. All payments are non-refundable once processed. You may cancel Monthly Plans at any time in your account settings, but you must cancel before the next billing date to avoid additional charges. We reserve the right to change the price of Monthly Plans at any time. If we change the price, we will email you at least 14 days in advance.

PAYMENT PROCESSING. We use a third-party processor (“PayPal”) to process your recurring payment. Payment processing is subject to the terms, conditions, and privacy policies of the Payment Processor, in addition to this Agreement. We reserve the right to make any corrections or instruct PayPal to make corrections to your payment.

REFUNDS ON FEATURED LISTINGS: If we offer a satisfaction guarantee for our "Featured Listings" service, it applies only to the first payment made by tenants or individual property owners. To qualify for a refund, you must request it before making another payment to feature the same listing. If multiple payments are made without a refund request, we will only refund the most recent payment. No refunds will be issued for earlier payments.

CHARGEBACKS. If you dispute a charge with your credit card company or bank (including initiating a chargeback or reversal), we reserve the right to suspend or terminate your account and refuse future service. Chargebacks are meant to address unauthorized use of your card; if you have any concerns about a payment, please email us first at [email protected] and we will do our best to resolve the issue directly.

We reserve the right to refuse service to anyone for any reason at any time. This includes instances of unprofessional behavior, such as being rude or disrespectful to other users. While complaints from other users may prompt us to take action, we may also choose to disable your access to Leasebreak based on our own assessment of your conduct, without the necessity of a formal complaint.

We reserve the right to refuse service if we find out users are sharing an account.
If we suspect a user is misrepresenting themselves, we may ask for additional verification which could include but is not limited to additional email addresses, a copy of a photo ID, access to social media profiles, and an on the phone or in person meeting.

You must be 13 years old or older to use this site.

It is your responsibility to keep your password safe and it is your responsibility to prevent others from using your account.
